a friend had an ebay transaction go bad........<surprise, surprise>
the purchase amount was only 30.00 bucks or so, but the guy/gal said they combined shipping, and they did, but at full price per item, no discount...so he dinged her 20.00 plus for shipping and only paid 3.25 to ship the item, so she is now into some heafty money.
he marked the items value at 150.00
dinged another 25.00+ for fees and taxes....
open the package, NOT anything like what she ordered....
email him, asked him what happenend to the items in the picture and description I was bidding on....that is sort of like those he says...that is what I was selling
not acceptable, I want a full refund

NOW...Thursday, she gets a refund of the purchase price from him, through Paypal, she did not pay him with paypal. This transaction went bad like a month and a half or two months ago

it was an unsolicited refund, she told him specically to forget it. ...and wrote ebay, did nothing....BTW

I dunno what to tell her, we held off refunding at this time unitl we discuss this

Actually, since the refund was not solicited, keep it.
Also, I think your friend is still out the duty. So call it even.

Your friend should be able to get a partial refund of the taxes and duty paid. If she looks at the backside of the customs form detailing the charges which was attached to the package, she'll see the application for refund plus a 1-800 number she can call for assistance. As proof of value, she can print out the auction and well as make a copy of the cancelled check or money order.
I claimed a refund once when I was erroneously charged duty (package clearly mailed from the U.S. but customs charged duty as if package was being mailed from Germany). The refund took several weeks to arrive, but it did arrive.

In my opinion, it would be dishonest to keep both the merchandise and the refund unless the seller states that it is O.K. to do so.

I totally agree Irene that it would be dishonest, but it ain't my call....and she probably won't keep it....just make him think she is keeping it, she is still sort of emailing with ebay but it appears as if they will do their usual nothing they are soooo famous for, what do they care, they got their fees.
And...this guy was dishonest, he showed new items, in the package, and sent cheaper versions some have been poorly stored and are damaged, the packaging on the rest was damaged in shipping because he crammed it into an envelope instead of a box and wrecked all the packaging on the others....to save himself a few bucks...
this guy is a nasty seller, his feedback is reflecting it
we really need to know, what can he do to her through Paypal and how long does she have to refund this payment, I told her to wait until the second last day then fire it back to him with a nasty note...WTH...she needs some satisfaction for all this money
we were wondering if ebay has been talking to him, but we will never know, can't figure out why all of sudden this refund showed up.
and nope, Canada customs said NO REFUND is due her, she bought it on ebay and this guy put the value down as such and what she actually paid is irrelevant as taxes are due on REAL value and this guy says that is what they are worth so that is it...blah blah...

I've never heard of GST being paid on anything but the purchase price.
As far as PayPal refunds are concerned, I do know that if you send a refund or partial refund of a PayPal payment to anyone and they don't accept it within 30 days, PayPal will automatically reverse the refund.
I am kind of confused why you think there is a time limit on MAKING a refund though. If the refund link disappears after a time, all your friend has to do is make a brand new payment and in the note section mention that the payment represents a refund of an earlier payment.

I just figured PP would have a time limit and this transaction was not originally paid with PP, this is not a refund per say or even a partial refund through their system, it is recevied like a payment, and I am not sure of the rules....
I got dinged last month by customs, I bought a bunch of old new stock, customs opened the package, decided it was worth wAAAAAAy more than I paid and dinged me for a lot of extra taxes
guess what, they are God and nope me no gets no refund even though I had my auction page, my invoice and my cancelled cheque....they said it was a new item and I was to pay full value taxes, even though the packaging said 1982, it is still NEW in their opinion. It also cost me about 10.00 in a phone bill because I couldn't get to the guy with the 1-800 number had to call long distance....

When I sale something and the customer complains I have two things that I do
If I think it is a legitimate complaint that was my fault, I refund all thier money and DO NOt request it be sent back _ I figure they've had enough frustation with the item, why make them mail it back
OR If I doubt them, I tell them to send it back and upong verification I will refund the money.
So to sum it up.....Unless the seller said send it back, I wouldn't assume that is what they meant.
Also, You said she didn't pay with paypal, so when he sent the refund how did he mark it, It couldn't have been as a refund and it shouldn't have been as an auction payment so I don't see why she should have to have proof of anything. IF I sent you 20 bucks for no apparent reason, I don't think I could just say to paypal, Hey I want that 20 back. And that is what his refund is "20 bucks for no apparent reason".
Or am I missing something completely.
