I'M IN DESPERATE NEED OF YOUR HELP RE FEEDBACK...PLEASE...

Question
Hi All!!
I've been shaking all night and trying to figure out how and what to do and I'm just drawing a blank. As most of you know, I've taken a 2 year break and just started to sell again as of the beginning of the year. I started to sell under my old ebay name and come to find out how drastically buyers have changed http://community.here.com/infopop/em...s/icon_eek.gif After my 2nd UNJUST neg in 6 years http://community.here.com/infopop/em...s/icon_mad.gif we decided to sell under a new ebay ID starting with very little feedback, but good. To make a long story short, we just received this neg: FRAUD proceedings to follow. No item. No communication even via EBAY. HUH??????????? This person from the start changed his email addy only hours before the EOA. We were emailing him his winning bidder notification instructing him to use our check-out service which would then calculate his total costs including shipping. He took it upon himself to not check-out and pay thru PayPal only the sales price. We emailed him and told him per our TOS, he needed to go thru our check-out which would then confirm his order and figure out his freight...we never received a reply. I finally billed him for the difference thru the paypal system. We finally received emails from him demanding his own TOS and if we don't mail him his item, he would leave neg feedback and report us for fraud to ebay and the USPS??? HUH???? He was trying to manipulate us on not paying the correct shipping, with feedback extortion, on and on. I wrote to ebay regarding this and only received back one of their form letters!! We were just going to refund this guys $$ as its not worth it to us to ruin our 'new' business with people like this...but then found this neg yesterday. We only have about 60 feedback, but now we have this showing in everybody's face. How do I deal with this you all?? I have saved all the correspondence between us and the buyer and my letter original complaint I sent to ebay. There is square trade, but don't know how good that would work as obviously he won't agree to feedback removal...This buyer is CRAZY!!
OK..I need to settle down here LOL...sorry for ranting...but I'm so frustrated. Where do I turn to fight this unjust neg. Your help is REALLY appreciated http://community.here.com/infopop/em...icon_smile.gif
(sorry in advance for the sloppy post)

Answer
Don't worry. http://community.here.com/infopop/em...icon_smile.gif Feedback extortion is against the rules, and eBay should remove the neg if you send them a copy of his e-mail where he said:

Refund his partial payment if you haven't already, block him, neg him back if you want, and don't think another thing about it. He can't very well file a fraud report if you have refunded his money! http://community.here.com/infopop/em.../icon_wink.gif
What a creep. http://community.here.com/infopop/em...icon_frown.gif Sorry you ran into a person like that! http://community.here.com/infopop/em...icon_frown.gif
Edited to add: Oh, and don't forget to report him as a non-paying bidder! http://community.here.com/infopop/em...on_biggrin.gif

Answer
No, don't run. They are everywhere.
Reply: "wont rd instrucs, wont pay shppng, threatns neg. We dont cave."

add a reasonable and rational reply like ....this guy is unreasonable-non communicating-changed email addy-sellers beware!!
and move on, list lots more stuff, get a bunch of positives and ignore him, he'll go away.

Answer
Just out of curiosity, What kind of checkout are you using & do your ads tell bidders that they will be required to use your checkout?
You will encounter some bidders that are reluctant to use a third-party checkout. It might save you some grief if you warn them in advance. (If it is in the listings, then nevermind. http://community.here.com/infopop/em.../icon_wink.gif )

Answer
Hi Mimi
Personally I would have kept the first username.
I have two negs, and life has gone on.
I think you'll find very few people read feedback.
A calm rational response, will speak volumes to those that actually do read it.
Microbes was saying that if the buyers email is different to the one he has registered with ebay, ebay will automatically eliminate any feedback he leaves.

Answer
actually we buy on ebay and we ALWAYS read feedback. Not sure why you think most people don't. However a few negs in a sea of positive fb.. are just bad fish in an otherwise placid sea. It's when the fb ration drops to 95% that you begin to ask questions.. such as.. do I want to buy from this so and so or not.

You do have to ask, but if the email (or the phone number, or both) that is on file is invalid, eBay will remove any feedback they left you.

I did email ebay the day we received that email with his original email along with all headers. We received the same 'automatic response' like they seem to always do, followed up by another email just saying sorry this happened and referred us to the ebay help area. I don't think they actually read any thing I wrote nor read his threating email http://community.here.com/infopop/em...s/icon_mad.gif I am actually at a loss on where to go next...

I'm really starting to wonder about that...I've always thought like that too...but not sure other peoples past grudges ever go away http://community.here.com/infopop/em...icon_frown.gif http://community.here.com/infopop/em...n_rolleyes.gif
<BLOCKQUOTE class="ip-ubbcode-quote"><font size="-1">quote:</font><HR> babyhippie Just out of curiosity, What kind of checkout are you using & do your ads tell bidders that they will be required to use your checkout?
<HR></BLOCKQUOTE>
Yes...definately, we list it a few times in our auctions either verbally or with clickable links. The checkout we are using is Vendio's.
<BLOCKQUOTE class="ip-ubbcode-quote"><font size="-1">quote:</font><HR> DoofyPersonally I would have kept the first username <HR></BLOCKQUOTE>
Hi Doof!! Actually I did originally keep my original name...but when I started noticing how much buyers have changed from a couple years ago, (such as the person who neged me) http://community.here.com/infopop/em...s/icon_mad.gif I decided to sell under another to try and keep my original ID safe. What I HAVE noticed is the buyers that have been with ebay for some time and have quite a bit of feedback seem to respond to email a little nicer to my original ebay ID with over 700 FB compaired to our other ID that has 60....seems like they bully the low FB ID. I really hate to say that, but I have noticed it too many times to think it was a coincident.
<BLOCKQUOTE class="ip-ubbcode-quote"><font size="-1">quote:</font><HR> I think you'll find very few people read feedback.
<HR></BLOCKQUOTE>
But the ones that do and they see that word "fraud" most likely with a response from us or not, it will put an unpleasant bug in their ear and probably go somewhere else.
<BLOCKQUOTE class="ip-ubbcode-quote"><font size="-1">quote:</font><HR>mucklepeas However a few negs in a sea of positive fb.. are just bad fish in an otherwise placid sea <HR></BLOCKQUOTE>
True http://community.here.com/infopop/em...icon_smile.gif but I think this neg is so drastic...more like "defamation of character" and can really hurt us http://community.here.com/infopop/em...icon_frown.gif
As of this writing, he had filied a PayPay dispute against us for a full refund, which we were going to do anyway. I responded to the dispute through PayPay and refunded his money. Question Can he refuse this refund for any reason or does he have to accept it because he filed a case against us??
Another question. The auction closed on Feb. 29th with his old email addy. He did not change it on ebay until a few days later, that is why he obviously wasn't getting our email nor the WBN. He also never changed his email addy on PayPal for well over a week, thus when I sent the first notice to him, PayPal was sending it to the wrong one. Can he be reported for violation of incorrect email addy since he didn't change it with ebay until after our auction closed?? Also...Do you all think that Square Trade could help us on this?? I didn't have a very good experience at all with them recently...Do they help with things like defamation of character, fraud, extortion, etc.?? or should I just stick with ebay??
