Copied Listing & Picture - Is this legal?

Question
I sold some fabric to a buyer just a few weeks ago and noticed that she's listed the fabric and copied my auction listing and picture.

I don't like this at all. Is it legal to copy like this? What would you do?
And I just noticed that she's done the same thing with 3 other fabrics she purchased. So, basically, she listed everything she bought and copied my listing and pictures to do it. Now I REALLY don't like this.

That depends. Is this something you sell all the time? If so, I might be tempted to turn her in to eBay for it. If the sale was a "one time deal" I'd just let it go.
I had the same thing happen to me once. It was something that I only had one of, so I let it slide. Funny thing was he paid me $52, and only got $11 when he cloned my ad and resold it.

To most people solutions mean finding the answers but to chemists solutions are things that are still all mixed up...

This is something I sell all the time. I have quite a stock of 3 of these fabrics so there's a lot left to sell.

It's aggravating when that happens. Don't know how you can discourage lifting text, but pictures are relatively easy. You just add text embedded in the picture. That's what I do with all of my pics/scans, I put our userID on all our pictures in spots where it would be impossible/extremely difficult to remove.
I took the time to scan or take the pictures and edit them, no sense in someone else using my hard labor to make themselves some money without giving me a cut http://community.here.com/infopop/em...icon_smile.gif

Copying images and unique text from your ads is against Ebay rules.
Whether Ebay acts on a complaint seems to depend on who at Ebay reviews it......,Ebay's "rules" seem to be rather inconsistent at times.
in any case, I would - and do - register a complaint every time such copying occurs.
Sure, the unscrupulous sellers will almost certainly go away eventually anyway, but the good ethics of the marketplace are essenial to its continuance.
When the marketplace is populated only by the unscrupulous, no one will go there to buy anymore...

Yeah! Ebay shut down the 4 auctions within 12 hours. http://community.here.com/infopop/em...on_biggrin.gif So the system does work. I see that she's reposted the auctions with her own very short description and her own pictures (not as nice as mine http://community.here.com/infopop/em.../icon_wink.gif).

Copying a listing and taking images is indeed against the rules and against many's principles. I am not one of them. I only sell pretty much one of anything. If I wrote a description worthy of using, great! Help yourself. If you want to use my pictures for something (as long as you don't lie and say you are holding the exact item,a similar item or like pictured would work) then go ahead and use my phots. Put 'em on your own server though 'cause you never know when I'll be cleaning my files up. But if you live close, just call and I'll shoot the pics for you.
