I Should Know This... PayPal Chargeback On Credit Card

Question
Here's the situation...
I recently purchased an item off a website that takes PayPal. I used credit card as my method of payment (VISA). The seller shipped the item in a VERY unsafe manner, and it was damaged. The total paid was $400. It doesn't qualify for PayPal Buyer Protection.... but... if I do a chargeback on my credit card, do I have a case?
And how does PayPal take it when you do that?

I have read a lot of posts-I think on T&S-that indicate you should file with paypal first even though you know it will be turned down and then file the CC chargeback. Supposedly paypal doesn't get angry and take away all your toys if you go through the ritual.
And yes your cc is your friend.........you can do a chargeback

The seller sold it to me for $400 with shipping included. Now she's saying it's my fault that she took a 1960's plastic toy robot, wrapped plain brown paper over it's original box, and gave it to the post office.... and I didn't tell her to buy insurance.
Well, guess what? Insurance would not pay anyway!
I got a package in the mail, and starting cutting the paper off with a pocket knife. When I saw that I was dragging the tip of the blade across the ORIGINAL BOX, I freaked!
This one is a total idiot.

As long as you file the buyers complaint with PayPal first they don't say anything if you call your CC company and initiate a chargeback. I've had 4 CC chargebacks in the last 3 months and haven't heard a peep outta PP.

I just had a totally hilarious 3-way conversation with my bank's credit card unit, and PayPal. The PayPal rep kept harping on PayPal's policy as if it were the policy of the entire credit card industry. Then I said, "See, PayPal is just a 'pass the buck' entity which tries to exist in the middle of the transaction and denies responsibility for it either way. If you simply process the chargeback against them, they will pay the chargeback and then go after their customer to get their money back." This made the PayPal rep insane, and she went off into a blathering spiel about why the claim can't be processed by PayPal and how the emails between me and the seller of the item can't be accepted as evidence of anything by PayPal. Then I explained that "PayPal wants the entire banking and credit card industry to adhere to their corporate policies, however if you just process the chargeback against them, they will pay it and go after their customer. PayPal is not helpful in these situations." The PayPal rep became shrill and ranted and spittled a bit and then hung up. My bank rep could not believe the way she was on the phone, and I explained that she was just trying to badger and bully us into not filing the chargeback. She laughed and said, "Well, that's not a very effective way to do that."

The saga continues...
My bank did retrieve the funds, a couple weeks ago. They put me on a conference call with a PayPal rep to try and work it out, and the bank did not understand why PayPal refused to simply refund the money and instead were forcing a chargeback. The PayPal rep ranted and raved and said a lot of stuff that didn't make any sense whatsoever to the banker, and I kept saying "she's just trying to confuse you with PayPal policy, which differs greatly from reality. Just file the chargeback on them, they will not cooperate." This made the PayPal rep go bonkers and quote more and more PayPal policy, and the banker stayed on with me after and mentioned how bizarre the conversation was...
So anyway, fast forward to today...
PayPal put a freeze on MY account (which has an $800 balance). Why? Because they say I reported that someone accessed it without my knowledge. I NEVER said ANYTHING like that WHATSOEVER! In order to get it back, I had to let them make a charge against my credit card, for $1.95, which they will credit back they say (actually, they charged it $2.15), and then when the transaction appears, there will be a number for me to see and enter in order to regain access to my account. Once again, this has not now, or ever, had a single thing to do with unathorized access to my account.
