Would You Buy If This Was in TOS

I ran across this auction for a book and this was in the auction TOS
Book Availability: All books may be sold elsewhere before the eBay listing ends. If you bought an out of stock item, we will cancel your order and issue a refund. Please do not leave negative feedback for cancelled orders. If I put an item up for auction, I certainly do not sell it elsewhere while it's on eBay.

I think, reading the Phoenix thread that this is ebay illegal.
however, seeing something like that on books of all things I would not bid.

No, I wouldn't bid.
Unfortunately, there are some booksellers who list a book across many selling venues at once. This is something that I've never done, nor would I. I can understand wanting to sell a book as efficiently as possible, but not at the expense of customer goodwill.
Such sellers often rack up negs/neutrals like crazy because of cancelled orders. It doesn't seem to discourage them from continuing to operate like this though.

If I put an item up for auction, I certainly do not sell it elsewhere while it's on eBay. Nor I! I wouldn't bid on it, either. However, better it's mentioned in the TOS than after the auction--that would be really annoying.
