We have acquired an old savings account passbook from 1921, that I want to list as ephemera, on ebay.
Is that legal to offer for sale?

If it has a zero balance, I would list it. If it has money shown as remaining, I would use some common sense. Usually banks have a clause that unused savings accounts are subject to either annual fees which draw them down, or the accounts are included in public notices before converting them to bank assets.
I usually prefer to just list things and not ask too many questions. Someone will always come up with a reason I shouldn't do something it seems. It is easy enough to cancel a listing if a problem reveals itself. But that is me. YMMV.

Brenda, they don't generally sell well, in my experience.
If they have good graphics and art, or some historical or local appeal,
it might do ok.

For example, a rather bland example I ran across turned out to be from the
first bank established in North Carolina, not long after the bank opened....
I played that up in the ad and title and did pretty good.

Otherwise, more have gone in the No Sell pile than out the door.

YMMV, of course.
