Question
Auction # 7315112033 American Marine Plates Set of 6 Plates. Paid for via Paypal and received by bidder on Friday, FB left. This afternoon, I get an email from bidder
Quote:
"I am disapointed in the plates after adding them to my collection the borders on all but one are very off centered. There was no mention of that and it is hard to tell from your pictures. Each plate has a different hue as well, I think that they are seconds. I am sorry to ask you this but can I send them back?"
I took a second look at the pictures on auction and it was clear to me that the plates had different hues. As for the border being off centered, that took a while for me to understand but that also is clear to me in the pictures.
TOS says as is, all saless final. High bidder asked no questions. If I don't refund, he can always do a chargeback or tell Paypal item was significantly not as described.
What's your opinion? Refund or not.
Answer
I would point out my TOS. That has worked for me. If not, I'd refund.
FWIW
Answer
I can't believe even PayPal would rule in her favor for a SNAD over those 'complaints'
The clue word there is 'significantly'
Your photos show the difference in color very clearly and I didn't notice that you used any word like 'set'.
However....I am usually in favor, in a case like this, of offering a refund....bid price only.... as long as she pays return shipping also and will quarantee to return them in unbroken condition
That is usually enough to deter the return.
Oh...you did say she already left FB, so, hey, you don't even have to do that, if you don't want
Answer
After looking at the auction, I say No Refund.
It was really hard to miss the "AS IS" notice... and I was skimming quickly!
They are clearly shown and your description was grand.
Stick to your guns.
Answer
I think everything was okay until someone in the family made a comment. Suddenly it is no longer perfect.
Your auction terms are pretty clear and direct. Don't see much of a reason for a refund. But for the small dollar amount, would refund if buyer willing to pay for at least one way of the postage. Would be great if buyer is willing to pay both ways of the postage. But in that case, not much of a refund left.
Answer
Your description, pics and terms are clear. Personally I wouldn't refund.
Answer
Your call as to whether you wish to stick to your TOS or make an exception in this case.
I did find the email quite polite to ask if there was a possibility if they could be returned. If there is a chance they might indeed be seconds (which might be something critical w/regard to the collectability of these items), you might want to take that into consideration in making your final decision.
Answer
well, I looked at the auction
transfer ware has variances in color, that is a fact a collector has to learn to live with or else pick through until they find all the exact shade.
I can't see the "off centered" border she referred to
all I see is maybe the patterns aren't on all plates straight in conjunction to the border, but I don't see how you can be held responsible for that, and it is visible in the pictures...and I went and looked at some of our transferware too, and most are not all on the plates the same way, this is mass produced dinnerware, it adds to the charm.
isn't that why we spend hundreds of dollars on cameras and hundreds of dollars on picture storage space every year....geez, at what point does a buyer have to accept just a bit of responsibility for their decisions?
Your ad said no returns, so I would go with no return if I were you.
Answer
What Gabs said. The color variations and the mis-aligned borders are the nature of transferware. Plus, your pictures and terms could not be more clear.
I almost always allow returns, but in this case I would refund bid price only, as it's clearly a case of buyer's remorse.
Answer
In consideration of the buyer"s reasonable and courteous email and feedback, along with the fact that she bought a more expensive dish from you in another auction, I would refund.
