Bought a poster from a seller. I received empty poster tube instead. Auction ended 3/25. I have been trying to contact seller but no response. Seller has racked up 30 negs since end of auction from people who have either not received their items or have received damaged items. The seller retaliates and leaves everyone negs that negs him or files with paypal. I bought with my selling id (was accident there I did bin and forgot that I hadn't switched ids). Item shows paypal buyer protection, so I'd probably get my money back (around $17) if I filed, but I don't want to get negged either. I have filed a nss report with ebay. I'm kinda hoping he gets booted before I file with paypal so that I can't get negged. Anything else I should be doing?

Hate to be blunt, but if you are scared of a neg, then forget the whole deal.
What you should do is file with paypal, leave him a neg and be done with it.
If you have a good feedback record and percentage, 99% of the buyers will never look at your feedback details. The 1% that does is probably intelligent enough to see the truth.

I have pretty good feedback. I have only 1 neg so far and 99.6% feedback. If/when he negs me, I'll go down to 99.3%. That would still be good right? The feedbacks he leaves are so crazy that he sounds like a lunatic and I doubt anyone would take it seriously, but I still don't like red. Kinda stings a bit.

I know there are varying opinions on this but here is mine.
Don't pay me, you will get a negative. Rip me off on a purchase, you will get a negative. Period.
I personally believe in the eBay feedback system & use it.

In case the seller is a buyer too, block him from bidding on any of your auctions.

You could also file the PayPal buyer credit request and not file the negative feedback. You could also go swear out a police report that the seller did not send you the item. The fact that you risked perjury in filing the report should add to your case.
It is possible but not certain that you could prove the tube was empty. Was the amount of postage shown and can you weigh the tube and determine how much postage was there for just an empty tube? If the tube had a poster in it, the postage would be higher to include the weight of the poster. You might prove your claim using that, if the seller didn't cover that angle. You also have a chance that the seller accidentally sent an empty tube. If it was accidental, they would still have the item there and unless it is one of dozens new, they should be able to tell it didn't get sent.
Did you try contacting the seller with the eBay contact form for emails and how about calling the seller using the lookup contact form? How about trying those first? Sometimes the seller updates email in eBay and the one sent via other sources is old and also they may have a spam filter nailing all your emails, but will pass the eBay originated emails through.

I've tried emailing him through the email addy I have for him, through ebay, and I've tried calling him (no one answers the phone).
I've got an email from another of his buyers telling me he did same thing to them and asking me if I got my item yet. I replied and told him that I received empty package as well. Then I emailed someone who left him a neg and asked if he received empty package as well, since his neg left for the seller was so vague. Someone else negged the seller saying not only did they not get their item but the seller gave a phony tracking number, but this person apparently got their money back from paypal already.

He has the item relisted. I guess it could be a duplicate though. But it's a really rare item, so it would be kinda hard to have too many of the item.
I went ahead and filed with paypal. Awaiting the red ink any moment now.

If you get a neg for this one, I would wear it with pride if I were you. And I'd email trust and safety explaining what happened, that this is a rare item and he has relisted it. Forward the email you got from the other buyer saying he too got an empty tube.

Yes, I emailed ebay all this info. My email box is getting full of those form emails telling me that they'll investigate but cannot reveal info emails. This other buyer that he ripped off and I are emailing all the others that have negged him for nonreceipt of goods and letting them know how to file the paperwork. Hopefully we'll get this one booted for this.
