less pieces than I paid for how would you handle it ?

I bought a box of 50 items on ebay I paid 54.00 with shipping
Its a item I use reguallrly and I like to buy at about 1.00 each
opened the box and counted (4 times ) only 30 pieces there
high volume seller , good feedback this is not a item he currently has listed so its not like he can send me 20
no TOS in his ad
what I want is around a 20.00 adjustment or return it for full refund (including shipping both ways )
how would you handle it ?

I agree with the advice given above.
Since I sell "quantities," I've goofed in my counting a couple of times.
I MUCH prefer the emails that say:
"Just wanted to let you know that I got my items today. I noticed though that there were only 15 instead of 20."
I always send them the missing 5. Perhaps this seller is wondering why he has so many leftovers.

I'm with ^^them^^. I'd send, ASAP, something like:

"Hi, I received the widgets and like them fine, however I only rceived 2/3 of the order. Are the rest perhaps on backorder? If so, I am eagerly awaiting the final 24 pieces. If not, I think a partial refund is in order. Please let me know, as soon as possible, when I will be receiving either the balance of the order, or the partial refund. Thanks and Sincerely, blah blah blah "

Now the ball's in seller's court. And hopefully you can do a chargeback or some such if seller turns out to be a scab. I always hope for the best, but prepare for the worst.

Too late now, but I disagree with the others. It seems to me that if you want something, you should ask for it. Sellers are not mind readers. To me its completely sensible for a customer to ask for what they want in a case like this. Unless you are trying to start an argument. If the seller proposes to simply send you the missing items, then what?

I think your response is fine and reasonable mango man. It is low key and that is usually the best in these situations.
There are always two views of these situations - the buyer's and the seller's. Unfortunately, until there is some communication it is pretty difficult to discern what may have gone awry. The menu of thoughts is usually the same though:
This isn't right...
Someone made a mistake!
Is someone trying to rip me off?
The order of these thoughts has a lot to do with what is communicated. I think it is premature to offer a solution until after the first communication.
