Does it make a difference how long one is employed to be considered eligible for Cobra? My sister worked from Dec 1, 2004 to March 11, 2005 when she was terminated and has yet to recieve her Cobra package. Another employee who was fired afterwards did recieve her package. She worked full-time at home and was enrolled in the health plan. Please reply as soon as possible. Thank you!

Was your sister enrolled in the health plan while she was employed?
While the length of time you were employed does not matter for COBRA, employees who were not on the health plan while they were employed are not eligible for COBRA, regardless of how long they may have been with the company.

Yes, my sister was enrolled since the start of her employment.

Her employer has up to 44 days to supply her COBRA information to her. If she was only terminated on March 11, they are WELL within the legal time frame.
If she has not received the COBRA information by April 24, she can call the US DOL and file a complaint. But she's got a LONG way to go before they are required to provide it, under the law.
