I am from NJ state. My wife was addmitted to Hospital on 06 Sep 2004 on OXFORD Health plan for complications in pregnency. She was on completely disabled and was on complete bed rest in hospital, until the baby is born Dec 9th 2004.
During her treatment for pregnency my employer had changed insurance company to AETNA from Sep 15 2004.
Now AETNA is saying that, since she was admitted on OXFORD card and was disabled so legally they are responsible for all hospitalization expenses. While OXFORD is denying the claims saying Policy was already terminated.
AETNA had already paid doctors expenses. But problem is with Hospitalization expenses.
I want to know, Who is reponsible for Hospitalization expenses. AETNA or OXFORD or both.

This is not a legal issue; it is a contractual issue. Without reading both policies, there's no way to say. The law does not make either carrier automatically responsible; it depends on what the policy says.
