Unfortunately, there are really too many unknowns in your post to say, and it wouldn't be in your best interest to answer some of the questions I'd have to ask, on an internet board.
What I would suggest you do is take a copy of your insurance policy and a copy of the insurance company's request to a local attorney. Many give free or low cost consultations. You'll want to find an attorney with insurance experience.
