My house was swept away by Hurricane Katrina. The deed was in my name, I bought it before we got married. But the insurance policy must have been in her name because they cut the check out just to her. Why would the insurance company have done this? Is it a requirement that the policy on a home be listed in the name of every person on the deed?
Now we are trying to agree on a divorce settlement, but she won't turn over the insurance proceeds, or even half of them, to me.What is the name of your state?

They are only required to write a check out to the name that appears on the declarations page, as well as the mortgage company. Its good practice for the spouse to be added to the policy, though. But, you can't really ask her insurance company, because its just that -HER insurance company.
