Our water heater from our condo, which we have rented, leaked water into the condo below us. The problem is that the owners of that condo live in England and supposedly had someone checking on it, but my tenant said that that person admitted to not checking on it very often. As a result, much more damage ocurred than would have if someone had been living there. We did not have insurance at that time. Their insurance company is coming after us for $25,000!!! We are willing to be responsible for some of the damage but don't feel we should pay for their negligence at not monitoring their property more closely. We refused to pay anything and the company is now sending the claim to their litigation department. Any thoughts?

Well the insurance compnay obviously thinks you should have monitored your water heater more closely and therefore you are negligent.

However, if you are the owner, then you are responsible. How did you not know that your water heater was leaking? Why didn't you have insurance?
