kids stupidity broke my garage door

Question
What is the name of your state? Az
The kid across the street from me was at our house two days ago. In his infinite wisdom he decided to try getting under the garage door, on my daughters bike when the door was only partially open. Needless to say he did not make it but the impact from him hitting it left the garage door badly damaged. He was not hurt. Do the neighbors have a legal obligation to pay for damages?

It seriously depends on the situation. It might serve you better to keep to one thread, you will get more answers that way

Answer
This is the only thread I've posted on.

Answer
Let's see?
The neighbor's child was @ YOUR house
on YOUR child's bike
playing under YOUR garage door
Supervised by YOU.
Who closed the door on him?
What you should be doing is contacting your homeowner's insurance, filing a claim for the repair of the door and advising them in case his parents sue YOU for injury done to their child on YOUR watch.

Answer
No you see I was at work. My daughter had instructions not to let any boys in the house. The neighbor knew I was at work as they see me leave every day! My daughter was not supposed to have any boys over and the neighbors child knew it. The neighbors son was not hurt however the garage door was! No one closed the door on him! The door was only partially opened when he decided to try and be evil kinevil,

Answer
My child will be pulling weeds and scrubbing floors with a toothbrush over the rest of her spring break.

I don't know how old your daughter is but be careful when her virginity is at stake or some boy will be playing Evil Kenevil with that! It is not the parents responsibility to monitor your commings and goings or supervise your child while you are at work.

Ohreallynow? What is a "nucience?" And we have no idea how old this "child" is...And you really seem to have a dirty mind?
I do not see what the need is to slam this mother for her child-raising skills. That was not the legal question she asked.
Classybroad, did you inquire of your neighbors if they would pay?

Answer
Thank you OHreallynow!
Yes I told them what happened and they said they would pay but asked if I would let the husband look at the damage to see if he could fix it. I agreed but I heard nothing back from them so I called a repair specialist.
It is good to know some people still come to this sight to give legal advise and not just to insult others.

Translation: You finally got someone that was not a bitter follower that wanted to help not hinder a poster.
Keep on the neighbor in a friendly way. It might be prudent to keep a paper trial. I seems silly to have to send a letter to them, but it might go down better if you have to take this to small claims court.
If you do have to go to your own homeowners insurance, your agent might want to do some investigation against the neighbor to get back their costs... .
Let us just hope they are embarrassed and just pay the costs. Getting an estimate is a good thing to do anyway.
Please try to forget the rmet and shay parie's (what the heck does that name mean anyway when I translate it it means :Shay-wager one' e... speaking of translation????)
I am not real great at insurance, better at contracts. (which you might want to get ) so Good luck... and let us know what happened if you are so inclined to post back.
( I would not blame you if you did not want to)

Ohreally now is a troll, who stalks me, a troll who gave you no relevant advise to the legal issues. Your neighbors have no obligation to pay you to repair the garage door, nor will you have a case to take to small claims court. Your options are to make a claim with your homeowners insurance or to repair it yourself. If your neighbors are kind enough to contribute then that is a bonus. Just because you don't like the answer doesn't mean the advise is incorrect.

I do not stalk nor am I a troll , but you should see her in action. Ohreallynow? phew. pretty scary stuff. You are lucky you or your child or the neighbor's child have not been diagnosed with some syndrome or something. HA!
Good luck Classy with your situation. And try to take "advice" from people who know what it is.
