I want to enlist my son in another Plan, but my current Plan will not cancel him without proof of new insurance. The new Plan will not enlist him without proof that he has no insurance. It's a Catch 22. I pay 100% of my son's current plan. Can I legally disenroll me and my son from the plan ? It's incencevable to me that I am told what I can do with my own money.

Why would an insurance company refuse to sign your son up if your paying the premium? It just does not make any sense, are you just moving from one individual policy to another (non employer sponsored) or is this possibly state sponsored health care, Medicare or Medicaid? It just feels like there is a puzzle piece missing.

The Plan I have now is United Health Care and the deduction taken out is "Med-pre tax". The plan I want to unroll him in is Child Health Plus thru NY State.

You may have to wait until your plan's open enrollment period to cancel his coverage with your employer's plan.

The reason you would have to wait for open enrollment is there is not a life changing event i.e. birth, death, marriage, adoption, etc.... You just want other coverage for your child and that doesn't qualify as a life changing event. It doesn't matter that you pay 100% of the premiums, that is how the plan is set up as most employer-sponsored plans are.

Also, when you sign him up for insurance through your company, you signed him up for a full year. The only way you could break that contract is for a "qualifying event" as mentioned before. Otherwise you can only make any changes in your plan at open enrollment. I don't think there is any way around this.

I appreciate all the replies. Can someone tell me if a change from Joint Custody to Full Legal Custody is a life changing event? I cannot afford this Health Care cost and may have to give my EX custody just to afford Health Insurance for the boy. Is that sad or what?

If there is a change in legal custody, you're telling me this is not a life changing event? If there was a court order for my Ex to pay, Could I cancel?
