Sorry about the CAPS! You guys are great! Her gutters overfloweth causing me a lot of damage. She wouldn't clean them out or provide any evidence of an insurance policy. My company says this is surface water and won't pay. Is roof/gutter drainage really surface water? Should her company pay me? Does it matter that she may have been unintentionally negligent at first, but it was intentional after she was notified?

If you think you have suffered damages, then sue her in small claims court and tell your story. See what the judge says.
