Question
I was sold the wrong type of home owner's insurance. I was sold a condo policy when I needed a single family policy. My house is classified as a condominium but it is "stand alone". My ins. agent told me that there was a master policy for my development but there isn't.
My house sustained major roof damage during hurricane Wilma and the condo policy that I have does not cover exterior damage.
Do I have ant legal recourse with the ins. agent?

Did your agent call the association to find out? Or did he just assume? Or did you tell him there was an association policy?
You may be able to find coverage under the insurance companies E & O policy. Call a lawyer as soon as possible.
Answer
The agent suposedly checked. This is a unique situation. My house is classified as a condominium. My insurance agent told me that there was a "master" policy when I bought the policy I currently have. There is no master policy. The agent apparently did not do the research.
Answer
Usually if you are in a condo, there is an association. But that doesnt mean that they carry insurance on the outer walls of your home (which is what they normally do). If your agent says he checked, he would have known this. It is apparent that he/she didn't ask the appropriate questions or researched the associations policy. Call an attorney now!
