Question
What is the name of your state? South carolina
hey
First time posting here. I hope someone can answer my question.
Heres what happened.
My wife recently went to her doctor because she found a lump in her chest. Thankfully she got the all clear. We live in the U.S but are from Ireland. All our families still live in Ireland. Because of this only my wife and myself knew about her going to the doctor.
We also own a bar/restaurant, and about a week after her first vist to the doctor, one of our custumors, asked my wife if everything was o.k. He knew ALL the details, knew she was getting checked for a lump, etc. Now this guys roommate works at blue cross blue shield, and have heard before that she has looked up other peoples private info.
Our insurance agent is checking to see if our files where opened.
My question is what are my legal rights, if I find out this person looked into our files, and then told people about it.
This has really got my wife up-set. We know for sure that NO ONE but ourselfs knew about the tests. I am also pretty sure that no one at the doctors office told him, because he does not know she got the all clear from the doctor, or at least not yet.
So any advice??
Thanks
Murph
Answer
You have the right to file a written complaint with the insurance company's Privacy Official, and the federal Office of Civil Rights. This was an inappropriate/illegal disclosure of private information.
