Opt-out doesn't apply to married couples

We just recieved the 2006 health insurance package. There is an option to "opt out", with compensation, if you are covered under another plan. My husband and I work for the same company. I carry the coverage for both of us, the deductions come out of my paycheck. I was told that this doesn't apply to married couples, only those who have coverage under another plan. Is this legal? My only option is for us to both carry our own insurance which would only save us about 1/5 of the payback we would recieve by the "opt out" plan.

Yes, it is legal.
The opt-out is for those who have coverage under ANOTHER plan. Doesn't matter whether you carry family coverage for both or you each carry single, you're both still going to be covered under the same plan. You don't qualify for the opt-out.
