Answer
Hi,
In most states I believe there is a time limit on how long to file the claim (ie: loss occurred on Jan 1 and you don't acutally file the claim for a year), but once the claim is filed it can remain open indefinately, either until the injury has healed or when you acutally settle. An insurance company can't just stop paying because a certain amount of time has passed especially if the damage from the claim (in your case injury) has not been resolved. I've seen physical therapy claims go on for years in Oregon. Yes, in many states you can ask for pain and suffering (some you can't). Adjusters may not offer (although good ones with good companies will) you must ask.
I can't answer on weather or not to get an attorney, but if you continue to have questions and aren't getting anywhere with the ins company, then legal advice might be a good option.
Hope this helps.
