Our small company terminated an employee 5/31/05. She elected to continue health insurance coverage under COBRA. She made the first payment just fine. We informed her that subsequent monthly payments would be due the 15th of the month for coverage the following month, i.e. June 15 for July coverage. We received her payment for July coverage on June 30 or July 1. Since then we have not received any payments. I understand that a 30-day grace period is required by law.
From our perspective, she is now more than 30 days late paying for August, since payment was due July 15. However, I was researching online and found some mention that the due date can't be earlier than the first of the month of coverage, so perhaps she will only be 30 days late at August 30?
When can we cancel her? Also, are we required to notify her before cancelling?
