What is the name of your state? What is the name of your state? What is the name of your state? Texas
How do you find out if someone abused power of attorney by changing another person's life insurance beneficiary to themself? In January of this year, my husband was the sole beneficiary on his father's policy. His father passed away last month and we were told by his ex-wife that she took power of attorney to handle his affairs and was also now beneficiary of his life insurance policy. She also cleaned out some bank accounts, etc. I know that money is gone and that's ok, she has to live with herself. We would however like to investigate changes made to the insurance policy. We live in Georgia if case that information is pertinent. Thanks in advance for your help.
Answer
Do you know the name and address of the insurance company?
You need to be getting an attorney to represent you.
Your attorney will know what to look for to determine whether your state has laws against abuse of power of attorney/elder financial abuse and if it is proven that this has occurred, POA will have to repay the monies she got to the estate. In some states, a POA is not sufficient to make changes to beneficiary designations on insurance policies.
