Question
I have a friend here in San Diego, CA who was fired from his job in April.
As recently discovered, 6 days later his employer cancelled his health benefits BUT they never informed nor offered him COBRA/Cal Cobra. About 10 weeks later he was in a bike/car accident (he was riding the bike) in which he broke his collar bone and wrist.
He is unemployed, uninsured and has accumulated over $30K in medical bills thus far.
Does he have any recourse against his former employers for not offering him COBRA?
Thanks.
Answer
Maybe. Why was he fired and how big is his employer? Did he ever call and ask about COBRA (not required by law but would help a potential case).
