Coverage Cancelled, Deductions from Payroll ongoing

Question
What is the name of your state? Nevada
Since 4-2002 I have had med insurance thru my employer payrol deducted. I just received two letters. One from my insurance company stating my coverage had been cancelled as of 4-30-05 and one denying payment on a medical bill dated 6-21-05 and 2 more bills pending still. How do I get my premiums back or my insurance coverage back and how can I be compensated for this? And my employer hasn't mentioned a word about the policy being cancelled.

Answer
Since this is a contributory plan there may be some DOL issues. When an employer deducts health insurance premiums from payroll there is a fiduciary responsibility. Check with your state DOI and DOL. They can advise you and may institute an audit of your employer.
This is much more serious than just a few bucks in premiums that are MIA. There are potentially much larger claims than yours involved.

Answer
Before you do that, check with your employer. The dates are just about right for there to have been a cancellation for non-payment of premium (as opposed to the employer actively telling the employer to cancel the plan) and if that is the case, in my experience (which is considerable) there's about an 80% chance that the coverage will be reinstated retroactively. If that is the case, there's no problem.
If the coverage is not reinstated or reinstatable, THEN follow somarco's advice.

Answer
thank you for your input, i talk to my employer and they say that the ins co never got a payment for april but they got may and june. The ins broker is working on getting it solved. If my employer goes with another ins co, how will by bills that i incured during the confusion be paid?
Thanks agian!

Answer
Impossible to say without knowing what dates of coverage might apply to which company or what arrangements your employer may make with the individual carriers.
