I'm being sued for $3,500 from a local hospital due to the fact that the insurance company denied our claim because my boss didn't pay the insurance premiums.
Health insurance was promised to me as part of my employee benefits (along with vacation, and sick leave) and he's admitted to not paying that month.
So, to make a long story short, is my boss liable for this $3,500 because he didn't pay that month (he did pay previous and consecutive months) or should we just cough up $3,500 and pay the bill?

If the plan is contributory, and deductions were withheld from your paycheck, there may be some DOL wage & hour issues. Employers have a fiduciary responsibility to remit payroll deducted premiums to the carrier on a timely basis or else refund those monies to the employees.
