Question
What is the name of your state? VA
I would like to know if my employer can access my medical records and see what doctors I went to. Thank you.
Answer
It depends on what you mean by accessing your medical records.
There is no on-line site that your employer can access and find your medical records. Such a site does not exist.
Except in VERY limited cases, your employer cannot contact your doctor without your permission; nor can your doctor send your medical information to your employer without your written permission. The exception would be for a workers comp claim; in filing such a claim you give up your right to medical privacy (at least, with regards to the workers comp claim).
However, IF your employer has a self-insured health insurance plan, then certain specially authorized employees in the HR department will have access to your medical bills and probably certain other medical information, for purposes of determining the eligibility of the claim under the plan and for payment purposes. By no means does that mean that anyone in your employer's organization can see them, and unless you work in HR for one of the authorized HIPAA personnel, your immediate boss will not see them.
Why do you think your employer has accessed your medical information.
