Question
What is the name of your state?iowa
In an earlier post I wrote that my ex wife got sent an insurance check that was made out to me and she forged my name and cashed the check and kept the money. Not only did she not say anything about this but, she told the orthodontist, where the money was suppose to go to, that we had the check and that they should call here to get it.....which they did, threatening us to pay them. Well, finally the insurance company fraud division found out that she had the money all along. The insurance company told us that we should contact the police and file a report on this because it is a crime and that if she did not pay them back that we would be held responsible. I did call the police and the officer that I talked to said that he was not sure if there was anything that they could do and that he would look into it. Last time I checked,,,insurance fraud and forgery is a crime. Something should be done legally about this, right?
Answer
Yes, what you described is illegal.

I am surprised the insurance carrier is not going after her.
You should be able to press charges persoanlly for her forgery.
I remember your previous case

That's what I thought, the police officer acted a little to casual about the whole situation and like he didn't really want to get involved or something. I just can not let her get off without nothing....she does things like this all the time and things need to change! If the officer doesn't really look into this can I demand that he do more or what are my options then?
Thanks!
Answer
You cannot demand that the police do anything. They do not have the time or the resources to investigate every crime that is reported to them or to arrest everyone you want arrested.
You can report what you know to the DA. HE will decide whether to take action against your ex-wife or not. It is NOT your decision.
If you want to file a civil case against her, see a local attorney.

Well...I didn't actually mean DEMAND that he personally do something about it! I just meant that if I allow her to keep pulling crap like this it will only get worse and worse! I will contact whoever I need to in order to get this taken care of.
Answer
Regardless, it is up to the authorities to decide whether to charge her with anything or not. If you want to file a civil suit, you can. But as far as forgery charges or anything like that, it's not your decision.

I understand that. As a matter of fact...I just received a phone call saying that they are looking into and they are going to pay the ex a little visit later today or tomorrow...whenever they can get ahold of her.
