Chase platinum 5K UA EQMs post early

If you're considering signing up for the Chase United Mileage Plus Platinum VISA and want the 5K EQMs for 2007 you may want to wait. I had received this card last month with the intent of activating and making purchases in Jan 2007. I was waiting because I do not need nor want the 5K EQMs for 2006. I found out today that my account did just receive 5K EQMs.
I have not activated the card and thus have obviously made no purchases. I have yet to receive any statement. The agreement states "Please allow 6-8 weeks from the time of your first purchase for your 5,000 Elite Qualifying Miles to be reflected in your Elite Qualifying Mile balance with United" So why did they post? Per Chase, my annual fee was charged and they consider this a purchase.
What a joke. If the EQMs post 6-8 weeks from the time of your first purchase or annual fee, they should say that. Their cardmember agreement, under 'Types of Transactions' and 'Purchase' says "You may use your card to pay for goods or services" It doesn't say anything about the annual fee being a purchase.
So basically whether or not you activate your card...regardless of the fact you have made no real purchases, your EQMs will be credited. Now instead of starting out 2007 qualification with 5K EQMs, I've got 5K posted in 2006 I don't need. The Chase rep. is supposedly sending their marketing dept a note and they'll get back with me.
Anyone had a similar experience or have good contact info. at Chase to help work this out?

I wonder if that would happen if you paid for it with choices/miles?

They did the same thing to me last year. I argued with about 10 different people at chase about it. Eventually I told them to cancel the card if they didn't fix it. They eventually sent me a letter saying that they had United apply the EQMs to 2006 instead of 2005. I still haven't confirmed if they actually did or not. They are terrible -- but there is a chance that they will fix it.
