Question
Well folks, my 2 week (forced) vacation has come to an end! --> Truck out of the shop, got a load of Office Max heading to the Windy… all seems well. Except…
The people at the insurance company have decided to play legal mumbo jumbo on me. Arguing that the dollar amount I quoted them for lost revenue was too high. Imagine that . I tell those jerks that I quoted them a lower amount than what I normally make, just to be kind. They want proof. So I send them my 1099 form. They don’t believe it. They say (and I quote) “truckers don’t make that much money in a year” --> . They want my tax form breakdown. So I send it, along with deposit records from my bank, and a yearly compensation form from my company.
Ok here’s the question (won’t be able to see your response’s for 2 weeks)
Should I…
A.) Stick with the polite dollar amount I first offered
B.) Crucify their butts and make them pay me what I really would of made? (since they pissed me off with the trucker remarks --> )
What would you folks do?

Answer
Your entitled to be "made whole". However, the insurance company can request proof to substantiate your claim.
Personally, I do not like sending anyone your 1099 or your tax forms.
We have utilized a very simply downtime calculation for years and it has apparently worked well for our clients. It gives a very good reflection of what that truck was earning and what the monetary damages are for it being down.
If you can substantiate the figures in writing, you should be able to reason with them. If you're just picking a number, you may run into some difficulty.
Remember, you want them to pay you. The longer it drags out the longer you're without the funds. The main purpose is to get what you are legally entitled to get.
If this is your insurance company you are dealing with, you will obviously have more leverage than if this insurance company represents another party.
Good luck to you.
