Question
Connie, I posted a thread in the law forum on this subject, but thought I would come over here and ask you. A driver involved in an accident driving for a company or an O/O, what kind of protection is available for this driver? The company has their lawyers and insurance, but say they come after the driver for a little infraction, there is any kind of insurance policy that drivers can purchase to protect themselves and their assets? I have heard quite a bit about an "Umbrella Policy" is this the answer?
With all the law-suits today, drivers should think very seriously about having some private protection instead of relying on the company to protect them. Go read what I posted in the law forum and tell me something.
Answer
An "employee" driver can purchase a personal umbrella, but it will probably not offer the protection you are seeking as incidents arising out of employment "may" be excluded as "business".
I hate to sound so vague, but unfortunately, it's difficult to predict what a court might say.
I would suggest getting a legal opinion with regards to ownership of assets and how to protect them from the situation you referenced.
