Well on 7/29/02 @ 9:30 am,(Indy time) at Werner's Indianapolis terminal, HERE'S YOUR KEYS, I QUIT!! Too many things were going to change the way things were being done! I HAVE HAD ENOUGH! I'll still check in now and then, BUT, AINT NO FREIGHTLINER IN MY DRIVEWAY NO MORE!!!!!( execpt for my 4X4 dodge truck!)P.S. You guys try not to ruffle ole I.R.R.'s tail feathers too much?

I think they need to review their ideas of how not to pay for unemployment benefits that I justly quailify for in the first place! Their "test" sounds like "programmed to fail". I know I couldn't be in a dark room all quiet like that and stay awake! Neither could most people, I think. Put me in a quiet, dark place, and I'm out! (Just ask GB! I am the queen of sleep!)
So why not be realistic and put you in a driving simulator? That would be more relevant.
Sleep apnea? What would this test prove? Maybe if you suffer from narcolepsy... Correct me if I am wrong, but sleep apnea is the cessation of breathing during sleep, and narcolepsy is when you nod off all the time and cannot stay awake.
If you lost your job due to failing some medical procedure, how can you be a "disgruntled" employee? (Well, I'd be disgruntled, all right, but it would be after the fact.) I don't know about there, but in Missouri, you have a right to appeal denial of Unemployment Benefits. You have a right to rebut "issues" which the former employer introduces. Almost all employers will introduce issues to keep from having to pay. But in most cases, if the employee has even half a case, they will win.
Call the state employment division, and ask to speak to a supervisor. Explain your situation and ask what your options are. Another avenue is to check on temporary or permanent disability. If you cannot drive, and get on disability, you may be eligible for paid training in a new field.
You may want to consult a lawyer who specializes in employment law. I'm pretty conversant with the law here, but every state is different!

there is a reason most trucking companies are located in just a few states,labor laws are more in the employers favor,than the employee's favor.
There is probably more to this than is being told,werner thinks that people can be operated by push button and should be rested whenever the HOS rules have been met,he probably did not have an on/off switch and plugging him into the sleeper for 8 hours at all different times of the day of night didn't work and he was late to offen.

You should talk to Opie the lawyer at the Law Forum,STAA laws might be able to cover this.
Do you really have sleep apnia or is werner just trying to convince you something is wrong with you because you are a normal person,that needs a regular sleep schedule.

Did you resign? If so, you won't be getting any unemployment, which basically helps folks who lose their employment income through no fault of their own. (layed-off, etc)
Was Werner going to pay for this test? If so, you might want take it and see what happens. You may pass it -- you said you only have to stay awake for 20 minutes, that shouldn't be a problem -- and they would put you on layover pay while you took it (maybe). And if you flunked it and could no longer qualify medically, you'd probably be eligiblie for unemployment.
As it is, you won't get another driving job with this hanging over your medical qualification (probably on your DAC, certainly on any reference from Werner.)
Of course, if you were going to quit anyway and this was the last straw (there's a lot of THAT going around), why waste your time and effort.
Congratulations on pulling the plug. Werner was probably overeacting to your medical conditions (that's the 'Werner Way') but if there was any chance it would affect your work -- you may have saved your life, and others, by hanging up the keys. A lot of drivers who fall asleep and died at the wheel may have had sleeping disorders that were never fully diagnosed. If you were worried about not being able to stay awake for 20 continous minutes to pass the test, you did the right thing.
Good luck with your future plans. If you can survive OTR, you've got the right stuff for almost anything you put your mind to.

Since when is a sleep apnea test a part of the medical exam for a class A license?
When you quit a job you are not entitled to unemployment money. You need to demand a hearing at the Unemployment office.
Education is the way to a better job and better pay.
