Drug Testing

Question
I have a sneaky suspicion that my pre-employment drug test may have a problem.I was with a group of about ten drivers and my results was the only one the only one that still did not come back.hmmmm I am not a drug user or over the counter drug user either. I do take a lot of vitamins including ginseng,ginko,Q-10 ,a multi, E, selenium,C,garlic,B-complex and flax seed oil. Could any of these effect the test?

Your post to the Law Forum below was wored a bit differently.

If I take a pre-employment drug screen and they mistakenly read it as positive what recourse do I have? I am not a drug user or over the counter drug user.I do take a lot of vitamins including ginseng(capsule),ginko,E,C,B complex, selenium,a multiple, garlic and Q-10(an oil for healthy heart) I took the test with about ten other drivers during orientation and mine was the only one that didn't come back. This was after 4 days.So everybody left with contracts but me.Hopefully there is a loss in the mail.But.... if not is it my fault that the test cannot tell the difference between illegal substances and vitamins and herbs? Is it my burden of proof? Can I sue for malpractice? Am I looking too deep at this whole situation?

Well, one for someone who new about medical, and the other for a more legal side of it .I thought about it more for the second posting and realized there was no flax seed oil. I thought that I would clarify that the ginseng was not the liquid kind that contains alchohol. Is there a discrepancy? The reason I brought it up is that I want to be prepared for a worst case scenario. It may just be an oversight and I am a nervous wreck because I really don't need this kind of hassel.CaboverPete

Answer
None of the items listed should cause any problems with your drug test. If they would be detected, they could result in a second test to try and determine if a masking agent was being used which could delay your results. But they should definitiely not report out as a positive result.
If there would be a positive result, what SHOULD happen is that you would be contacted by a physician (Medical Review Officer) who would ask you questions about medications and such. He/she will tell you that there is a positive result and what drug tested positive. If you feel that the result is an error, you have the right to request that the split part of the specimen be transferred to a second SAMSHA certified lab for retesting. This will be at your expense. A positive result is NOT supposed to be reported to the employer until the MRO has spoken with you.
My concern is that 10 of you were tested at once. Who did the collections? Did you observe your specimen being labeled and sealed correctly in front of you? Or did you just set it on a counter with others and walk away?
Let us know how things turn out.

Hi Nurse Red, Thanks for giving me the drug info.. I called the carrier today I was told that not only was my drug test not in, my background check was not completed either.(The carrier has orientation every two weeks so I applied electronicly with E mail and faxes.I wanted to get going as soon as possible.I guess I got ahead of my paperwork.)The safety guy I talked to on Friday just said drug test and that is what caused my concern. The person I talked to today said it was not unusual for the results to be late because the lab does not test in any particular order.I guess I'll buy that, so I am now cautiously optimistic.I am now thinking that perhaps the other guys drug results were not in either and that is more a paperwork thing-hopefully a misunderstanding. I am glad I found this website and will use it often.I do have to work around three teenagers and an avid E-bay user to get some computer time though. Thanks for the help. CaboverPete
