What does the Law say about On -the -Job Heart Attacks????

Question
On January 1st of this year my husband suffered a Heart Attack while we were waiting to be loaded in Yuma, AZ. After informing the Owner of the family owned Company we drove for, they sent another team to pick up our truck 8 hours later. The hospital flew my Husband to Phoenix,AZ three days later to have stents implanted. We had been under a considerable amout of stress due to our loading/unloading schedule, plus our pay wasn't that great and we were having a very hard time making ends meet. Anyhow, his Mother and Brother flew to Phoenix and then rented a car to get us back to Mississippi where he could coninue medical treatment and have family support. Our company offered no health insurance and his medical bills were around $100,000.00. He was released back to work 2 weeks later, but he still wasn't back up to par, eventually due to a lot of other problems with the company we worked for decided before we lost any more money, we terminated our employment. Anyone here have any ideas about this situation?

Answer
If you are looking for a reason to file suit, you are going to spend more money in attorneys than you have spent on medical bills.
It sounds as if (and correct me if I am wrong) that you are looking for a way to blame the cardiac problem on the company thereby making them responsible to pay the medical bills.
Cardiac problems are caused by a variety of things (Heredity, Congenital abnormalities, Diabetes, Obesity, etc) and proving that a heart attack was brought on purely by stress is going to be very difficult, if not impossible to prove.
If you wish to pursue this line of thinking, then you may want to talk to a Worker's Compensation attorney. BUT.....First you must have been employed (not leased) by that company and you must prove that the company willfully contributed to the problem in some manner.
You knew you had no medical insurance prior to this situation, why didn't you pursue getting coverage elsewhere? I know it is expensive, but it would have paid off in the long run.
I suggest that your hubby focus on getting better. Improving his health. And getting into a line of work that is not quite so demanding, hopefully with a company that has health benefits.
Good luck to you and keep us posted on his recovery. Our thoughts are with you.
Keeping you safe, healthy and on the road.

Hello,
Thanks for replying, but to be honest with you we are not trying to blame the company. I wanted to know if whether we had to file a claim or if there was anything we could do. As for finding insurance elsewhere, we couldn't even afford to pay our bills out on the road with this compnay, that is why we no longer work for them. Let alone trying to get a papycheck out of them was another story. But, I do have some good news, yesterday one of the hospitals called after I had posted the message, and they are wrting the bill off, so that helps a great deal. anyway, thanks for the reply. Have a great day!!!
